Welcome to Techowiz, a technology platform operated by Chaperone Solutions LLP, having its registered/business address at Plot No. 615/1209, Vijaynagar, Samalpur, Balasore, Odisha – 756056, India.

These Terms and Conditions (“Terms”) govern your access to and use of the Techowiz website, application, Health CRM, portals, dashboards and related services collectively referred to as the “Platform”.

By registering, accessing or using the Platform, you agree to these Terms. If you do not agree, you should not use the Platform.

1. About Techowiz

Techowiz provides technology solutions that help patients, doctors, clinics, hospitals and authorised third-party organisations manage healthcare-related workflows, including appointment management, patient records, medical history, enquiries, leads, departments, doctors, fees, schedules and related administrative activities.

Techowiz is a technology service provider and Health CRM platform.

Unless expressly stated otherwise, Techowiz:

  • is not a hospital, clinic, diagnostic centre, pharmacy or healthcare provider;
  • does not itself provide medical advice, diagnosis, treatment or prescriptions;
  • does not independently verify or guarantee medical advice provided by a Doctor or healthcare institution;
  • does not create a doctor-patient relationship between Techowiz and any Patient; and
  • is not responsible for clinical decisions made by healthcare professionals using the Platform.

2. User Types

The Platform may provide different features and permissions depending on the type of account.

2.1 Patients

Patients may, depending on the features made available:

  • create and maintain their profile;
  • search for or interact with participating Doctors or Hospitals;
  • book, reschedule or cancel appointments;
  • upload medical history, reports, prescriptions and other health information;
  • raise queries;
  • receive appointment-related communications;
  • view information made available by healthcare providers; and
  • access other patient-related services available through the Platform.

Patients are responsible for ensuring that information submitted by them is accurate and up to date.

2.2 Doctors

Doctor accounts may be used by individual practitioners, clinics and small healthcare teams.

Doctors may, depending on their permissions:

  • create and maintain professional profiles;
  • configure appointment slots and availability;
  • set consultation fees;
  • manage appointments;
  • access authorised Patient information;
  • review information shared by Patients;
  • respond to Patient queries; and
  • perform other healthcare-administration functions available through the Platform.

Doctors are solely responsible for maintaining all licences, registrations, qualifications and permissions required to practise medicine or provide healthcare services.

2.3 Hospitals

Hospital accounts may, depending on their subscription and permissions:

  • manage Patient records;
  • manage appointments;
  • add and manage departments;
  • add and manage Doctors and staff;
  • configure Doctor fees and appointment slots;
  • access authorised Patient information;
  • manage internal healthcare workflows; and
  • use other administrative features provided by Techowiz.

Hospitals are responsible for determining which employees, Doctors and authorised representatives may access Patient information through their account.

2.4 Organisations

Organisation accounts are intended for authorised third-party entities, including lead-management or administrative partners working with Hospitals.

Depending on permissions assigned by the relevant Hospital or administrator, Organisations may:

  • manage leads and enquiries;
  • manage authorised Patient information;
  • manage appointments and related workflows;
  • add or manage departments;
  • add or manage Doctors;
  • configure permitted Doctor fees and appointment slots; and
  • perform other authorised administrative activities.

Organisations must access and process Patient information only to the extent authorised by the relevant Hospital, Patient, applicable agreement and applicable law.

An Organisation must not access clinical or medical information merely because technical access is available. Access must be necessary, authorised and appropriate for the purpose for which the Organisation is engaged.

3. Account Registration

Users may be required to provide information such as name, mobile number, email address, organisation details, professional information or other details necessary to create an account.

You agree to:

  • provide accurate and complete information;
  • keep your information updated;
  • maintain the confidentiality of your password, OTP and login credentials;
  • not share your account with unauthorised persons; and
  • promptly inform Techowiz if you suspect unauthorised access.

You are responsible for activities carried out through your account unless caused by circumstances attributable to Techowiz.

4. Patient and Medical Information

The Platform may permit Patients and authorised healthcare professionals or institutions to upload, store, access or process medical and health-related information.

This may include medical history, consultation information, prescriptions, reports, allergies, symptoms, treatment information, appointment history and other information submitted through the Platform.

Patients should provide information that is accurate and relevant to their healthcare.

Doctors, Hospitals and Organisations must access Patient information only for legitimate and authorised purposes and in accordance with applicable privacy, healthcare and professional requirements.

Healthcare providers remain responsible for determining whether information available through Techowiz is adequate for any medical or clinical decision.

5. Patient Authorisation and Institutional Access

By choosing to interact with a Doctor, Hospital or other healthcare provider through Techowiz, a Patient understands that relevant information may need to be made available to that provider for appointment management, treatment, care coordination or related services.

Where an account is operated by a Hospital, clinic or Organisation, the relevant institution is responsible for establishing appropriate access permissions for its personnel and authorised service providers.

Institutional users must implement appropriate internal controls to prevent unauthorised access to Patient information.

6. Appointments

Techowiz may facilitate appointment booking between Patients and Doctors or Hospitals.

Appointment availability, duration, consultation fees and related conditions are generally determined by the relevant Doctor or Hospital.

Techowiz does not guarantee that:

  • a particular Doctor will be available;
  • an appointment will begin at the exact scheduled time;
  • an appointment will not be cancelled or rescheduled; or
  • a particular treatment or consultation outcome will result.

Any cancellation, rescheduling, refund or payment terms displayed at the time of booking or communicated by the relevant healthcare provider will apply to that appointment.

7. Consultation Fees and Payments

Doctors and Hospitals may use the Platform to configure their consultation fees.

Where payment functionality is provided, payments may be processed through authorised third-party payment service providers.

Techowiz may not directly receive, store or process complete card, banking or payment credentials where such information is handled by the payment service provider.

Additional payment, cancellation or refund terms may be displayed during the relevant transaction.

8. No Medical Advice by Techowiz

Information available through the Platform should not be interpreted as medical advice from Techowiz.

All diagnosis, treatment, prescriptions, clinical recommendations and other medical decisions are the responsibility of the relevant qualified healthcare professional.

Techowiz does not endorse any particular Doctor, Hospital, procedure, medicine, treatment or healthcare service merely because it appears on the Platform.

9. Medical Emergencies

Techowiz is not an emergency medical service.

The Platform should not be used as a substitute for emergency medical attention.

If you or another person is experiencing a medical emergency, immediately contact the appropriate emergency service or visit the nearest hospital or emergency healthcare facility.

Do not wait for a response to a query, appointment request or message submitted through Techowiz.

10. Responsibilities of Doctors and Healthcare Institutions

Doctors, Hospitals, clinics and other healthcare providers using Techowiz are responsible for:

  • maintaining required registrations, licences and professional qualifications;
  • providing accurate professional information;
  • complying with applicable medical and healthcare regulations;
  • maintaining appropriate Patient confidentiality;
  • ensuring lawful access to Patient records;
  • obtaining any consent or authorisation required for their healthcare activities;
  • ensuring their personnel use the Platform appropriately; and
  • making independent clinical decisions.

Techowiz may request reasonable documentation to verify an institutional or professional account.

11. Responsibilities of Organisations and Lead Managers

Organisations handling enquiries, leads or Patient information on behalf of a Hospital must:

  • act only within authority granted by the Hospital;
  • use Patient data only for authorised purposes;
  • comply with confidentiality obligations;
  • avoid unauthorised marketing or solicitation;
  • not sell Patient information;
  • not independently disclose Patient information to another party without lawful authority;
  • restrict access to personnel who require it for their work; and
  • promptly report suspected unauthorised access or data incidents.

12. Acceptable Use

You must not use Techowiz to:

  • access another person’s information without permission;
  • impersonate another person, Doctor, Hospital or organisation;
  • upload deliberately false medical or professional information;
  • obtain Patient records for unrelated commercial purposes;
  • unlawfully advertise, spam or solicit Patients;
  • sell or trade Patient information;
  • upload malware or malicious code;
  • attempt to bypass security or access controls;
  • scrape or extract Platform data without written permission;
  • interfere with the operation or security of Techowiz;
  • reverse engineer the Platform except where permitted by law;
  • violate intellectual property rights;
  • commit fraud or any unlawful activity; or
  • use the Platform in a way that violates applicable healthcare, privacy or data-protection laws.

13. Institutional Administrators

Hospitals, clinics and Organisations may designate administrators who can create accounts, assign roles and manage permissions.

The institution is responsible for actions taken by its administrators and authorised users.

Techowiz may provide technical access-control functionality, but the institution remains responsible for deciding who should receive access and what level of access is appropriate.

14. Third-Party Services

Techowiz may integrate with third-party services such as:

  • payment gateways;
  • SMS, email or messaging providers;
  • cloud infrastructure;
  • video consultation tools;
  • analytics tools;
  • authentication services; or
  • other technology providers.

Use of certain third-party services may also be subject to the third party’s terms and privacy practices.

Techowiz is not responsible for independent services provided directly by third parties outside Techowiz’s control.

15. Intellectual Property

The Techowiz name, software, interface, workflows, designs, trademarks, logos, databases, documentation and other Platform materials owned by Chaperone Solutions LLP are protected by applicable intellectual property laws.

Except for the limited right to use the Platform in accordance with these Terms, no ownership rights are transferred to a user.

Users retain rights in content and information lawfully submitted by them, subject to the permissions necessary for Techowiz to host, process, transmit and display that information for providing the Platform.

16. Confidentiality

Doctors, Hospitals, Organisations and their personnel must treat Patient information and other confidential information accessed through Techowiz as confidential.

They must not download, disclose, copy, transmit or use confidential information except where required for the authorised purpose or permitted by law.

17. Security

Techowiz takes reasonable technical and organisational measures intended to protect Platform information.

Users and institutional customers also play an important role in security and must maintain appropriate password, device, personnel and access controls.

No electronic system can be guaranteed to be completely secure.

Users should immediately report suspected unauthorised account activity to support@techowiz.co.in.

18. Availability of the Platform

We aim to maintain reasonable availability of Techowiz but do not guarantee uninterrupted or error-free operation.

Access may occasionally be affected by:

  • maintenance;
  • updates;
  • security incidents;
  • internet or telecommunications failures;
  • third-party service interruptions;
  • infrastructure failures; or
  • circumstances outside our reasonable control.

19. Suspension and Termination

Techowiz may restrict, suspend or terminate access where reasonably necessary, including where:

  • these Terms are violated;
  • fraudulent or unlawful activity is suspected;
  • Patient confidentiality may be at risk;
  • an account presents a security risk;
  • required fees remain unpaid;
  • a professional or institution loses required authorisation; or
  • suspension is required by law or competent authority.

Where appropriate, reasonable steps may be taken to provide notice.

20. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Techowiz is provided on an “as available” basis.

Techowiz does not guarantee any particular healthcare outcome, Patient volume, lead conversion, revenue, appointment volume or business result.

Doctors, Hospitals and healthcare institutions remain independently responsible for healthcare services provided by them.

21. Limitation of Liability

To the extent permitted by applicable law, Chaperone Solutions LLP shall not be responsible for indirect, incidental, special or consequential losses arising solely from:

  • medical decisions taken by independent healthcare providers;
  • incorrect information provided by a user;
  • Patient failure to seek appropriate medical attention;
  • unauthorised access caused by compromised user credentials;
  • conduct of an independent Doctor, Hospital or Organisation; or
  • third-party systems outside Techowiz’s reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

22. Indemnity

Institutional and professional users agree, to the extent permitted by law, to indemnify Chaperone Solutions LLP against claims, losses or liabilities resulting from their unlawful use of the Platform, unauthorised access to Patient information, violation of professional obligations or infringement of third-party rights.

23. Privacy

Use of Techowiz is also governed by our Privacy Policy, which explains how personal information may be collected, used, shared, retained and protected.

24. Changes to These Terms

Techowiz may update these Terms when required because of changes in:

  • Platform functionality;
  • business operations;
  • regulatory requirements;
  • security practices; or
  • applicable law.

The updated version will display the revised “Last Updated” date.

Where required by applicable law, additional notice or consent will be obtained.

25. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to any rights or forums available to consumers or other persons under applicable law, disputes relating to these Terms or the Platform shall be subject to the jurisdiction of competent courts in Balasore, Odisha, India.
